The Website elenamaidoni.com is an online Art Gallery/ E-Gallery which markets original paintings created by Elena Maidoni. The pieces are exclusive, handcrafted, and they are not available in massive production or in copies (each item is unique). This policy/terms & conditions will apply to the use of this Website and govern the relationship between the E-Gallery (hereinafter referred to as “E-Gallery”) and individuals who view our Website (hereinafter called “visitors”). Access to and use of the Website by the User is subject to these Terms of Use and presumes unconditional acceptance of all the present Terms of Use on the part of the User. They constitute the contractual framework which governs the relationship between the User and the Company at any given time. Make sure you agree to the following terms and conditions as any transaction with us through this Website www.elenamaidoni.com is governed and bound by the following terms. Your transaction with us implies the irrevocable acceptance of these terms.
All content of the Website is subject to change at any time without notice, at the sole discretion of the Company/E-Gallery. The User must frequently visit the Terms of Use as they may be amended, modified or revised, whenever it deems necessary without there being any other obligation for information about such amendment, except for their being posted on the Website. Each artwork is original, authentic, one of a kind, handcrafted and unique and the intellectual property rights over the content of the website belong to the Company and are protected by the applicable laws on intellectual property rights.
- All content of the website, including original artworks, texts, titles, descriptions, images, icons, graphics, logos, videos, photographs, designs, web pages, tools, the characters and design of the website, layouts and provided services are intellectual property of ELENA MAIDONI and protected by the relevant provisions of Greek law, European law and international conventions.
- The appearance and exhibition of the artworks and all content of the website should not in any way be construed as a transfer or granting of the licence and/or a right to use thereof. Both users and any third party are prohibited from publishing, managing, distributing, copying in whole or in part, transferring, altering, storing, republishing, amending, or reproducing in any other manner, in any form, any part of the content or copies of the content that appear on this website. Users are also not allowed to amend, translate, decompile, reconstruct, or create derivative works which appear in the www.elenamaidoni.com. The works of art, texts and the overall content appearing on the website exclusively belong to the Company. The user or any third party does not have and does not obtain any permission or consent to use any of this material, without the official written permission of the Company. The reproduction of the website and its contents, whether in full or in part, is prohibited in any form, without the explicit written approval of Eleni Maidoni who has the exclusive right to authorize οr forbid the reproduction.
INTELLECTUAL PROPERTY RIGHTS
- A person who buys a work of art will own the piece of artwork but will not own the copyright to it; the copyright and the intellectual property rights belong to ELENA MAIDONI. No purchased artwork may be copied, recreated or reproduced by any process, without prior written proof of permission.
- RIGHTS TO IMAGES: The artist reserves the right to use and sell reproductions of sold work at any time in the future, in order to promote her work. All reproduction rights are retained by the artist herself.
- All works of art are copyrighted, legally protected by law and as a common practice, the paintings of ELENA MAIDONI E-Gallery are being subject to timestamp legal procedure by a notary, as an additional evidence of authentication and ownership of the original paintings.
Intentional /willful violation of copyright laws is considered a criminal offense and it involves financial or/and other consequences. The Company reserves its rights to take legal action for potential copyright infringements/violations and to claim damages through the courts and an accredited lawyer may be assigned to track and trace potential infringements.

Authenticity of original artworks
As regards the conveyance of authenticity, main of the practices followed, without being limited to them, are the following:
- COA (Certificate of Authenticity): Every artwork is an original and carries a Certificate of Authenticity issued in an exclusive, single piece and signed by the artist, as a documentary proof that it is the genuine creation of the artist. It is the “identity” of each painting and informs about the artist, the mediums and materials used, the dimensions, the creation year, the UIN, the date of purchase and bears a handwritten signature.
- Signature: On the front side of the artwork, either embedded on the front lower side or on the framing/mounting as being a constituent part of the artwork. Its positioning depends on the nature of the artwork and aesthetics criteria so as to be smoothly incorporated into the piece. The COA also bears the artist’s signature.
- UIN: Every piece carries a Unique Inventory Number. It is indicated on the Certificate of Authenticity.
- Golden mirror-like label with the artist’s name on the back side.
- Registering: The prevalent practice of the artist, without though being obligatory or a requisite, involves artwork registration as a means of additional ascertainment which further conveys the artwork identity and authenticity.
USER OBLIGATIONS
The users of the www.elenamaidoni.com website and the online store agree not to use it to send, publish, send by e-mail or otherwise transmit any content that is unlawful, harmful, threatening, abusive, harassing, vilifying, defamatory, vulgar, obscene, libelous, violates the privacy of another, shows empathy, or expresses racial, ethnic or other discrimination, may cause harm to minors in any way, should not be transmitted in accordance with the law or contractual or management relations (such as inside information, proprietary and confidential information obtained or disclosed as part of employment relationships or covered by confidentiality agreements).
They agree not to use it in any way that infringes any patent, trademark, trade secret, copyright or other proprietary rights of others, contains software viruses or any other computer code, file or program designed to interrupt, damage, destruct or prevent the operation of any computer software or hardware, intentionally or unintentionally contravenes the applicable Greek and EU legislation and its provisions and may harass a third party in any way and any content used to collect or store personal data of the users.
Access permission and use of the E-Gallery
Use in any manner, or another kind of exploitation of the website and its content for professional or commercial purposes is prohibited. The Customer is granted a non-exclusive permission of access and personal use, which shall by no means entail permission to take up or amend the website or any part thereof. Such access permission granted to the Customer does not allow any resale or commercial use, reproduction, creation of copies, copying, transmission, announcement, placement on the market, amendment, or assignment of permission, or any other manner of exploitation of the site or its content, any collection and use of any lists, descriptions or photographs of products, or any use of data extraction tools, robots, or similar data collection and extraction tools.
Moreover, the trade names which may appear on the E-shop are duly subject to legal protection. Its use is allowed only provided that the Customer acts in a fair and lawful manner and abstains from any action that causes harm to the reputation of the Company, or from any unlawful exploitation thereof. The Customer is also prohibited from creating any connection that insinuates any kind of relationship of the Customer or a third party with the Company, or approval or support by the Company where there is none. It is not allowed to place the E-shop in a frame on any other website, and, in any case, the Customer is prohibited from creating any link to any part of this website other than the homepage.
Ordering/ shipment/ delivery
- PRICES: The prices of the products include the value added tax (VAT). The Customer is charged with the shipping costs. There is the option that the prices appear in euros (€) or in dollars ($). Prices are subject to change without notice at any time. The Company shall not be liable for any potential modification.
- CUSTOMS TAXES & DUTIES: Orders shipped outside of the European Union (EU) may be subject to sales taxes. This cost is covered entirely by the customer. Please carefully check the customs taxes and duties applicable in your country.
- SALES TAXES AND DUTIES: Orders shipped outside of the European Union (EU) will be subject to custom taxes and duties. This cost is the responsibility of the customer and is payable on receipt of delivery of goods. Please check carefully your local custom tax and duty costs.
- Artworks that are shipped to New York addresses will incur NYS sales tax of 8.875%. There is no sales tax when shipping to other states in the US. For legal reasons, we must declare the full value for all international deliveries. Please note that you will be responsible for any customs or import taxes on international shipments, which are due upon arrival at the destination country.
Shipment
- If the artwork is available, it is shipped within the next 2-5 working days. The aforementioned timings of 2-5 days do not apply to bespoke / custom-made piece).
- For commissions (bespoke, custom-made artworks), timings are discussed and agreed per case depending on the nature of the project (technique, size etc.) as well as the time period. (Please also take into consideration that at least 72 hours are needed upon completion and before the shipment of the artwork, so that it meets materials specifications and reaches its optimum level).
- If special mounting or/and back lit equipment is asked, it takes up to 7 working days for the addition to be handcrafted, – depending on the case as it is personalized and fully customized and hand-made.
- For special cases (i.e. weddings, events etc.) please communicate it the soonest possible so as to prioritize and organize accordingly.
ADDITIONAL SHIPPING DETAILS
- The time varies as an “official export permit” also has to be issued from the National Gallery (a legally binding authorization to export an original artwork).
- All works are wrapped in protective shipping material and sent in a rigid cardboard box. Please allow 2-5 working days for processing and 1-2 weeks for delivery depending on the destination as well as the type of shipping (DHL standard or DHL express). Orders can take up to 3-4 weeks for delivery (or more if it gets held up in customs); we are not responsible for international taxes and duties.
- Various parameters are taken into account for the calculation of transportation costs such as volumetric data, weight, factors regarding what is considered fragile as well as the destination country. DELIVERY
Once your order payment is confirmed and you receive the relevant notification email with your shipping code. Delivery time varies depending on the country as well as the selection, (DHL express or DHL Standard/Economy*).

PAYMENTS
For payments via credit/ debit card, the payment service provider will process your credit/ debit card information and billing address on the basis of Article 6(1)(b) of the GDPR (processing is necessary for the performance of a contract). For these transactions, the respective contractual and data protection provisions of the respective providers apply. The use of the payment service providers is based on Art. 6(1)(b) GDPR (contract processing) and in the interest of a smooth, convenient, and secure payment transaction (Art. 6(1)(f) GDPR). Insofar as your consent is requested for certain actions, Art. 6(1)(a) GDPR is the legal basis for data processing; consent may be revoked at any time for the future.
PAYMENT METHODS
- A) Payment by Credit/Debit Card:
- We accept all credit and debit cards (VISA, MASTERCARD, VISA DEBIT, MAESTRO, DINERS).
- All payments by credit or debit card are made through the services of __ Bank and Paypal.
- When you select one of these methods at the checkout, you will be transferred to the respective website of X Bank or Paypal to make your payment. Once you have completed the payment process, you will automatically return to our website to confirm your order and you will receive a relevant email with the subject “Payment confirmation”.

If the consumer chooses the bank deposit as a method of repayment, then it should be made within 4 calendar days. There is an extra transport cost.
Please enter as rationale for your deposit the code of your order. After the deposit, our accounting office is directly informed about your payment through the automated system and since your order is being made electronically you will receive a relevant e-mail with the subject “Payment confirmation”.
NOTE: For transfers made from different banks than those in which the e-gallery has an account, the expenses of the banks are borne entirely by the originator
RETURNS
FRAMEWORK: The changes of the art industry, the new models and modern technology give the opportunity of a thorough overview of the painting and bring art collection into a new era. The virtual, remote operating models (i.e. video and its zoom options, In Situ visualization of an artwork into your space etc.), allow to examine texture, pigmentation, details and get the full picture of a piece, at the comfort of your private space, allowing to choose your artwork carefully. In any case, there is a 14 day return policy.
- a) Original works of art
The intention is to safeguard the interest of both the client as well as the e-gallery, to reassure the optimum outcome and smooth process for both parties, and to prevent from unfavorable circumstances. Returns are accepted within 14 days from the date of receipt and provided that the items you wish to return are in excellent condition and without any damage. They should be in their original packaging, including the certificate of authenticity, any other accompanying material as well as the sales receipt or invoice.
There is the possibility to choose another item of the same or higher price while paying the difference. If the consumer does not wish to replace it at the specific time period, then the company provides a credit note or a gift voucher of the purchased value, which can be used in the future within a 12 month time from the issue date.
In any case, make sure you choose your artwork carefully so as to avoid returns of original paintings, taking into account the following:
- Each piece is one-of-a-kind. The works of art are original, unique, handcrafted and cannot be recreated, replicated or replaced. Especially in the case of resin artworks which have a glossy, glass-like and sensitive surface, any potential imperfections caused may irreparably affect the nature and the value of the painting. In the potential case of return/exchange, it entails the risk of being accidentally damaged (i.e. scratched) if not handled safely due to improper handling and/or packaging. Likewise, if an artwork gets damaged during its return from a customer, it is not accepted.
- The shipment costs which are borne solely by the customer (except from the case of Attica/Greece where you may return the item personally, free of charge). It is highly recommended that you use a delivery service which has a tracking service of its deliveries, so you can easily locate where your return is, and verify prompt delivery to our offices.
- Pandemic shipping delays hindering the process.
- It is a complex, time consuming process. (In the potential case of a damage caused during return, the artist would need to assess the damage, furnish an appraisal for the value of the damaged work, decide if it is repairable, make an estimate for restoration costs, reassure that the damage claims are processed through the shipping company etc.).
- In the unlikely event that the Customer receives a product with defects i.e. due to transportation, or if any other problem arises, the Customer must promptly contact us and send an e-mail at contact@elenamaidoni.com within the same day by showing the respective proof of damage, in order to settle this issue.
In any case and before you deliver the order and give your consent on the proper status of the packaging by signing to the courier company, make sure that the packaging is in good condition. The Company is not liable for damages caused by the Customer (i.e. dropping down the painting after opening the packaging), thus, timely communication and proof of damage would be needed.
RETURNS
- b) Commissioned /EXCLUSIVE Custom-made pieces
No returns are accepted for commissions (custom-made art) and personalized pieces exclusively created for a collector. The same applies for pieces with custom made framing/ mounting and/or back lit add-on equipment or other additions there were not in the original piece (i.e. addition of gold leaves, copper or other stones).
- c) Other “objets d’art”, gifts, lifestyle items
The company may refund you for a return, if you exercise the withdrawal right within the time limit of 14 days. There is the option of return and exchange with another item within the same time limit (14 days from the date of receipt) and provided that the items you wish to return are in excellent condition and without any damage. The items should also be in their original packaging and include the sales receipt or invoice.
When the consumer returns an item there is the possibility to choose another item of the same or higher price while paying the difference. If the consumer does not wish to replace it at the specific time period, then the company provides a credit note which can be used for a future purchase.
The return costs and customs charges are borne solely by the customer. The customer must ensure the safe return of the products and that they arrive in our offices at their original state. It is highly recommended for the returned items that you use a delivery service which has a tracking service of its deliveries, so you can easily locate where your return is, and verify delivery to our offices. If a piece gets damaged during its return from a customer due to the handling and/or its packaging, return is not accepted.
Delivery & acceptance of ORDERED PIECES
The Consumer undertakes to promptly check the delivery for any visible damage to the external packaging and to notify us via e-mail, within and no later than 3 (three) calendar days of receipt of the order.
- A signature is required upon delivery for added security. Before you deliver the order and give your consent on the proper status of the packaging by signing to the courier company, make sure that the packaging is in good condition. (The Company is not liable for damages caused by the Customer i.e. dropping down the painting after opening the packaging, thus, timely communication and proof of damage caused during transportation, would be needed).
- If you notice any serious and visible damage to the outside of the package please do not sign for the delivery and contact us the soonest possible and no longer than 24 hours of receiving the artwork, along with digital images of the damage showing it was damaged in transit and we will endeavor to settle the issue (to replace it with another piece or arrange a refund upon receiving the returned damaged artwork and corresponding Certificate of Authenticity and all its accompanying material and packaging).
- In the unlikely event that the Customer receives a product with defects i.e. due to transportation, or if any other problem arises, the Customer must promptly contact us and send an e-mail at contact@elenamaidoni.com within the same day by showing the respective proof of damage, in order to settle this issue.
In any case, transportation to your address should not worry you as the packaging is absolutely safe and tested (wrapped by layers of protective material and externally enclosed in wooden case, when considered necessary).
ORDER CANCELLATION
You can cancel the order in the following cases:
- Before the order is completed, during the online process of the order you can go back and remove the quantities of the products from your cart by clicking on “remove” button.
- If you have completed the online order but the product has not yet been dispatched, you can contact us via the contact form of the website and we will undertake the cancellation of your order.

- Visual/audio content: An archive of photographic material and video recordings may be used in order to organize and promote business related activities. Collecting and posting this material on the website or publishing it in general is done with the prerequisite that the individuals (subjects) depicted have in advance provided their free and explicit consent for the above purposes.
- Your IP address, your browser type and language when browsing our website.
All the aforementioned are necessary for the initiation, execution and maintenance of our business relations.
How we use your personal information
If you contact us via e-mail or telephone or submit inquiries to us via contact form, all information provided therein will be stored by us in order to handle your inquiry, process your request or in the event that we have further questions. We will not process this information without your consent. If you subscribe to the newsletter/mailing list, we will need from you an e-mail address and information, which allows us to verify that you are the owner of the e-mail address provided, as well as your consent to the receipt of the newsletter about exhibitions and new artwork and collections release. For example, day/month of birth field may be optional to fulfill for the case of organizing special activations (i.e. reward initiatives). We shall use such data only for sending you the requested information and we shall not share such data with any third parties. These general terms and conditions of sale are governed by Greek law. For any dispute concerning the validity, interpretation or execution of these General Conditions of Sale and Privacy Policy the Courts of Athens shall have exclusive jurisdiction.

How we use your personal information
MAILCHIMP: This website uses the services of MailChimp to send out its newsletters. The provider is the Rocket Science Group LLC, 675 Ponce De Leon Ave NE, Suite 5000, Atlanta, GA 30308, USA. Among other things, MailChimp is a service that can be deployed to organize and analyze the sending of newsletters. Whenever you enter data for the purpose of subscribing to a newsletter (e.g. your e-mail address), the information is stored on MailChimp servers in the United States. If you do not want to permit an analysis by MailChimp, you must unsubscribe from the newsletter. We provide a link for you to do this in every newsletter message. The data is processed based on your consent (Art. 6 Sect. 1 lit. a GDPR). You may revoke any consent you have given at any time by unsubscribing from the newsletter. This shall be without prejudice to the lawfulness of any data processing transactions that have taken place prior to your revocation.
Use by minors (under 18 years old)
We do not knowingly collect data from people under 18 years of age. By using the site, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the site.
